Domain names

Did you know that a domain name can also be a trade mark? That’s why, if you choose a domain name that includes or is very similar to someone else’s already-registered trade mark, you could be infringing it. In addition, if you are in the same area of business as the trade mark owner, you can be prevented from using that domain name and its registration could be cancelled. If you are in a different business, then this may not occur, which is why it is so important when registering your own trademarks that you take advice on which goods and/or services to cover from the start.

No wonder that domain names are a frequent source of conflict. Because of the international nature of the Internet, it is not always possible to get a domain name which is completely free of conflict, which is why using our expert advice can save you so much trouble in the future.

How We Can Help

  • We search for existing trade marks to check the risk of infringement
  • Advise you on how best to protect your domain name if it also functions as a trade mark
  • Negotiate on your behalf to try to resolve any conflicts amicably
  • Present your case before a domain name registry where there is a dispute either with or against another party
